How Are Damages Calculated in Discrimination or Sexual Harassment Cases?

Vincent White, from White, Ricotta & Marks, P.C. discusses how damages are calculated and explains the reality of what one can expect in comparison to what the media uses as the norm when reporting damages owed. Mr. White explains that there are three different types of damages: economic, emotional, and punitive. Economic damages will depend on many factors including if you have already found a new job or if you are looking for a new job. Mr. White explains that while the media usually reports stories of emotional damages in the millions, this is not usually the case. There are many factors that can cap the amount you can ask for and many variables that can affect if how much you may be rewarded for emotional damages. He also explains that you should be leery if you have an attorney that promises you millions because of the long list of variables. The third factor is punitive damages. These damages are awarded to send a message to the company that they cannot just choose to ignore the law. This number is decided by figuring out what number will send that message to the company in question. There is no sure fire way to give a client an amount before going through the process but finding an attorney that believes in the case and does their due diligence will optimize your chances for a satisfactory result.
